Terms and Conditions for FinEd4us

Introduction Welcome to FinEd4us! These Terms and Conditions (“Terms”) is a legal agreement between you and SeaPea I LLC, doing business as FinEd4us, and governs your use of our mobile app and related services, whether you are using the free or paid subscription version. By downloading, installing, or using our app, you agree to be bound by these terms. Please read them carefully.

If you are under the age of 13, you must obtain parental consent to use the app. If you are a parent or guardian, you must supervise your child’s use of the app.

1. Acceptance of Terms

By accessing or using the app, you agree that you have read, understand, and agree to comply with and be bound by these Terms and Conditions and our Privacy Policy. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT USE THE APP. The Terms are subject to change at any time.  Your continued use of any part of the app or any service constitutes your acceptance of such changes to this agreement. You should review the Terms periodically to determine if any changes have been made. 2. Age Restrictions

• Users Aged 11 and Above: The app is intended for users aged 11 and above. If you are under 13, you must have permission from a parent or guardian to use the app.
• Parental Consent: For users under 13, we require the consent of a parent or guardian to collect personal data, in compliance with COPPA (Children's Online Privacy Protection Act).

3. Information Only, Not Financial Advice

The content provided in the app, including text, data, charts, analysis, and other materials, is for informational purposes only. It is not intended to be a substitute for professional financial advice, investment advice, or any other form of professional advice.

• No Professional Relationship: The use of the app does not create a financial advisory relationship, nor should it be construed as financial guidance or consultation. You should seek the advice of a qualified financial professional before making any financial decisions or investments.

5. Limitations of Liability

By using the app, you agree that in no event will FinEd4us or SeaPea I LLC and its affiliates and its affiliates be held liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the app or the reliance on the information provided within the app. This includes, but is not limited to, financial losses, loss of profits, or damages to your financial portfolio.

6. Confidentiality.

 It is agreed that all personal information given to FinEd4us and SeaPea I LLC, will be kept confidential by FinEd4us and SeaPea I LLC, unless you actively chose to post your personal information for others to see. Any password used for the app is for the Client's individual use only. You will be responsible for the security of your password(s). From time to time, FinEd4us may require that you change your password. You are prohibited from using any services or facilities provided in connection with this app to compromise its security or tamper with any of its system, resources and/or accounts. The use or distribution of tools designed for compromising security (e.g., password crackers, rootkits, Trojan horses, or network probing tools) is strictly prohibited. If you become involved in any violation of system security, FinEd4us and SeaPea I LLC reserves the right to release your account details to system administrators at other websites and/or the authorities in order to assist them in resolving security incidents. FinEd4us reserves the right to investigate suspected violations of this Agreement. FinEd4us and SeaPea I LLC reserve the right to fully cooperate with any law enforcement authorities or court order requesting or directing FinEd4us to disclose the identity of anyone posting any e-mail messages, or publishing or otherwise making available any materials that are believed to violate these Terms.

7. Ownership, Copyrights, Trademarks, Licenses.

You acknowledge and agree that the app and any software or programs used with respect to any app services contain proprietary and confidential information that is the property of FinEd4us and its licensors and is protected by applicable intellectual property and other laws. No rights or title of to any of the proprietary and confidential information on FinEd4us or any software used in connection with any of its services is provided, transferred or assigned to you. You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on any of FinEd4us services or software, in whole or in part. Trademarks, service marks, logos, and copyrighted works appearing in the app are the property of the FinEd4us. FinEd4us retains all rights with respect to any intellectual property appearing on the app, and no rights in such materials are transferred or assigned to you.

8. Third-Party Content and Links

The app may contain links to third-party websites, resources, or services that are not controlled by SeaPea I LLC. These links are provided for your convenience, and we do not endorse, control, or assume responsibility for the content, privacy policies, or practices of these third-party websites. We encourage you to review their terms and policies before engaging with any third-party content.

9. No Guarantee of Availability

The app and its services are provided "as is," and we do not guarantee that the app will be available at all times or without interruptions. We reserve the right to modify or discontinue any features of the app at any time without prior notice.

10. Account Registration

To access certain features, including premium content, you may be asked to create an account. You are responsible for maintaining the confidentiality of your account information and are fully responsible for all activities under your account.

• Parental Access: Parents/guardians may request to review or delete the personal information we have collected about their child under 13 by contacting us at supportsquad@FinEd4us.app.

11. Free and Paid Subscriptions

FinEd4us offers both free and paid subscription models. The free version provides basic functionality, while the paid subscription provides access to additional features and content.

• Free Version: The free version of the app offers limited features, which can be used without making any payments.
• Paid Subscription: The paid subscription provides access to additional premium features. Subscription fees and billing details are outlined on the app store or within the app itself.

Billing and Payment:

• Payment will be charged to your account at confirmation of purchase.
• Subscriptions are billed on a recurring basis (e.g., monthly, yearly) and will automatically renew unless canceled before the next billing cycle.
• You can manage and cancel your subscription at any time through your app store account settings.

12. Prohibited Conduct

You agree not to engage in the following prohibited activities while using the app:

• Engaging in any illegal or harmful activity.
• Uploading, posting, or transmitting content that is discriminatory, offensive, or violates the rights of others.
• Attempting to hack, manipulate, or interfere with the app’s operations.
• Using the app to harass, threaten, or intimidate others.

13. Privacy and Data Collection

We are committed to protecting your privacy. Our Privacy Policy explains how we collect, use, and share your information. By using the app, you consent to our collection and use of your data as described in the Privacy Policy.

• COPPA Compliance: We do not collect personal information from children under 13 without parental consent. Parents can contact us to review or delete their child’s personal information.
• Data Sharing: We may share non-personally identifiable data for analytics or advertising purposes.

14. In-App Purchases

The app may offer in-app purchases, such as virtual goods, premium content, or additional features. By purchasing any in-app items, you agree to the terms associated with those purchases.

• Refund Policy: All purchases are non-refundable unless required by law.

15. Subscription and Payment Terms

• Subscriptions will auto-renew unless canceled by the user at least 24 hours before the end of the current period.
• The cost of the subscription is outlined at the time of purchase, and the payment will be charged to your account according to the app store’s terms.

16. Indemnification

You agree to indemnify and hold harmless SeaPea I LLC and FinEd4us, its employees, affiliates, and partners from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the app or any violation of these Terms and Conditions.

17. Termination

We may suspend or terminate your access to the app if you violate these Terms and Conditions. In such cases, you may lose access to any content you have purchased or created.

18. No Warranties

SeaPea I LLC and FinEd4us are not responsible for any damages arising from your use of the app, including but not limited to data loss, service interruptions, or third-party content. The app is provided "as is" without warranties of any kind.

19. Changes to Terms

We may update these Terms and Conditions at any time. If changes are made, we will notify you via the app or by email. Continued use of the app after such updates will constitute your acceptance of the new terms.

20. Governing Law

These Terms and Conditions are governed by the laws of the state of New Jersey. Any disputes will be resolved in the state or federal courts located in New Jersey.

21. Severability

If any provision is found to be invalid, the remaining provisions will be in full force and effect.

22. Waiver

The failure of FinEd4us or SeaPea I LLC to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by FinEd4us or SeaPea I LLC must be in writing and signed by an authorized representative of the SeaPea I LLC.
